Placement or installation of the device, network coverage, location, congestion and many other factors may affect the performance of Solid GPS Products and the availability of tracking services and functions.

Solid GPS and its employees do not, under any circumstance, guarantee the tracking of your vehicle, asset, or item, or the recovery of any tracked vehicle, asset, or item.

All services, including the performance of the Solid GPS Tracker, are subject to device and software capabilities, network limitations, and availability. Solid GPS does not guarantee uninterrupted coverage or uninterrupted connection to GPS or cellular services.

While Solid GPS’ tracking device and software are useful tools for monitoring assets, theft deterrence, and theft recovery, Solid GPS does not guarantee the protection or security of property containing its tracking devices. Solid GPS disclaims responsibility for any losses caused by software or hardware error, notifications, mapping inaccuracies, incorrect tracking data, scale, resolution, or date.
To the fullest extent permitted by law, Solid GPS shall not be liable for theft, damage, loss of profit, loss of anticipated savings, loss of data, loss of use of the product or any associated equipment, or indirect, incidental, or consequential losses or damages of any nature.

Solid GPS does not tolerate abuse of staff. If a customer engages in abusive behavior towards any Solid GPS staff member, Solid GPS may, at its discretion, discontinue service. In such cases, the customer must return the tracker for a refund of the appropriate amount owed once the tracker is returned.

Solid GPS may terminate services if:
There is a breach of these Terms;

The customer engages in abusive, unlawful, or fraudulent conduct;

There are operational, technical, or legal requirements necessitating termination.

In the event of termination not caused by the customer’s breach, Solid GPS will refund the appropriate portion of any prepaid subscription fees (if required by law) upon return of the tracker.

The Terms contain details regarding device performance, network capability, and availability relating to the “Solid GPS” network. Solid GPS may provide services over any telecommunications network it considers appropriate. Network providers may change without notice and service performance may vary. Solid GPS does not guarantee performance of any third-party network.

A connectivity subscription fee is payable in addition to the purchase price of the tracking device. Subscription fees may change from time to time. Subscriptions are payable by credit card via the Solid GPS website through Stripe.

Subscription fees are non-refundable except where required by law, or where Solid GPS terminates service without customer fault.

To avoid being charged for renewal, subscriptions must be cancelled before the renewal date. Customers will retain access to the service through the end of the paid period.

Customers may opt in to receive email marketing from Solid GPS. Consent can be withdrawn at any time by using the unsubscribe link in marketing emails.

We do not represent or warrant that the Solid GPS Product, software, web application, mobile application, service, or network is entirely secure, uninterrupted, or error-free.
To the extent permitted by law:
All implied conditions, terms, and warranties are excluded unless expressly set out in these Terms.

Our liability for breach of a statutory guarantee which cannot be excluded is limited, at our option, to supplying the product/service again or paying the cost of having it supplied again.

Our total aggregate liability for all claims, whether in contract, tort (including negligence), statute, or otherwise, will not exceed the total amount paid by the customer for the Product and service prior to the date of the claim.

You indemnify and hold Solid GPS harmless from all losses, damages, claims, liabilities, costs, and expenses (including legal fees) arising from:
(a) periods when tracking devices are offline or unable to connect;
(b) any third-party claim related to the property being tracked;
(c) any negligent, unlawful, or fraudulent act by you or your representatives.

If you are not completely satisfied with your tracker, you may return it within 31 days of purchase for a full refund of the purchase price, subject to the following:
Eligibility
Return must be initiated within 31 days of purchase date shown on proof of purchase.
This policy applies only to purchases made directly from Solid GPS and not from other parties.

Condition
For change-of-mind returns, the tracker must be in original condition with all packaging, accessories, and documentation.
For faulty products, original packaging is not required.

Return Shipping
Customers are responsible for return shipping costs. Solid GPS is not responsible for items lost or damaged during return transit.
International customers must mark parcels as “Aus warranty return – value <$20”.

Refunds
Refunds will be processed within 5 business days of receiving the returned product.
Refunds will be issued to the original payment method.
Subscription fees are non-refundable.

Solid GPS warrants that its products are free from defects in materials and workmanship at the time of purchase. This limited warranty applies for twelve (12) months from the date of purchase, unless otherwise stated.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Customers are entitled to a replacement or refund for major failure and compensation for any other reasonably foreseeable loss or damage.

The warranty does not cover defects caused by:
Tampering, modification, or unauthorized repair;
}Damage from water, heat, environmental conditions, or corrosion;
Use outside intended purpose or contrary to the user manual;
Normal wear and tear;
Cellular network changes outside Solid GPS’ control;
Use with unauthorized accessories;
Strong magnetic fields or proximity to magnets.

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

Solid GPS is not liable for delay or failure to perform obligations due to events beyond its reasonable control, including natural disasters, power outages, telecommunications failures, or regulatory changes.

If any provision of these Terms is held invalid, the remaining provisions remain enforceable. Solid GPS may amend these Terms from time to time by providing notice on its website. Continued use of the service after an amendment constitutes acceptance of the updated Terms.

This product contains a battery. Do not burn, crush, or expose to extreme heat. Do not submerge in water. Do not open, tamper with, or attempt to reverse-engineer any part of the Solid GPS device. Breach of these safety warnings may void your warranty.
